Early Termination of Probation (Penal Code 1203.3)

A petition of early termination of probation can be made when you have completed all terms and conditions of probation except for the actual period of probation. Terminating probation early is up to a judge’s discretion. Most judges will not consider early termination unless you have completed more than half of your probationary period and even then, judge’s will look to several factors before granting such motion.

These factors include:

  1. The time that you’ve been on probation,
  2. The remaining time of your probationary period,
  3. Probation violations,
  4. Reasons for seeking early termination,
  5. Your overall criminal history, among others.  

The more favorable evidence you provide to support early termination of your probation the more likely that a judge will grant your petition.
